The Driveway Debacle

We had a past client call us the other day in panic. We will call him Bob. Names have been changed to protect the innocent. His new neighbor, Nabob, told Bob that Bob's driveway was on Nabob's property, and that Bob would have to start paying Nabob rent to use the driveway.

Your Legal Description is Wrong

We had an interesting transaction last year. Our clients, the Marbles, (names have been changed), were looking for a second home. We found an estate property that was a really good deal. The property was held in a trust. The owner had passed away, and his children (the successor trustees) were selling the property.

There's a Septic Tank?

Our clients wanted to purchase a property is a subdivision that happened to have a private water and sewer system. The MLS record for this property, and indeed for every property for sale in this subdivision, lists Private Sewer, and says nothing about septics. We were quite taken aback when the sellers disclosure mentioned an alternative septic system. We further researched the property, and found a septic permit for the property.

Your Foundation is Illegal

Our clients were interested in a manufactured home property off of Hwy 169. This property was fun to research in that it had one problem after another. The most interesting issue was a deed restriction, but we'll get to that in a minute.

Where's the Permit?

This is an unfortunate case that happens all the time. These were not our clients, but they later contacted us when they decided to move into a larger home. They were unhappy with their previous agent, who did almost no research for them and rarely gave an opinion about anything. When they started describing their current home, we quickly realized which house it was. We had previously shown this house to another client who walked away from it after our research. The home has an unpermitted Arizona room.
